The court found that the suit land was jointly registered in the names of the defendant and the applicant's father as a first registration. By operation of law, upon the death of the applicant's father in 1988, the entire interest in the land vested in the defendant as the surviving joint proprietor, pursuant to Section 102(1) of the Registered Land Act and Section 60 of the Land Registration Act, 2012. The defendant was therefore entitled to deal with the land, including subdivision, without the consent of the applicant or his family.
