The High Court found that the trial magistrate erred in awarding damages on the basis of permanent disability when both medical experts agreed the respondent suffered only temporary disability. The trial magistrate's departure from expert medical opinion was unjustified and amounted to an erroneous aggravation of the respondent's clinical condition. Upon reviewing comparable case law and the nature of the injuries, the court held that the award of Kshs.800,000 was excessive. The court substituted the award with Kshs.680,000 in general damages, subject to the agreed 50% contribution, and ordered that each party bear their own costs of the appeal.
