  1. 1 Whether the High Court has jurisdiction to review a sentence to account for pre-conviction custodial period after resentencing.
  2. 2 Whether the petitioner is entitled to a reduction of sentence by the period spent in custody before conviction.

Ratio Decidendi

The High Court determined that it lacked jurisdiction to review or reduce the sentence imposed during resentencing in a previous petition, even if the petitioner alleged that the resentencing court failed to consider the period spent in custody before conviction. The court held that any challenge to the resentencing decision, including claims of oversight of material factors, must be addressed to the Court of Appeal, not by way of a fresh petition before the High Court. Accordingly, the petition was dismissed for want of merit and jurisdiction.
