Procedural Posture

Criminal Appeal / Judgment

  1. 1 Whether the prosecution proved the offence of stealing and stealing a motor vehicle beyond reasonable doubt.
  2. 2 Whether the trial court erred in its evaluation of evidence and findings of fact.

Ratio Decidendi

The court found that the prosecution failed to prove the offence of stealing and stealing a motor vehicle beyond reasonable doubt. The evidence showed that the complainant and appellant cohabited and that the complainant delayed reporting the alleged theft for two years, which undermined her credibility. The appellant's defense that the vehicle was gifted to him was plausible, especially since the transfer of ownership was effected using lawful documents and the trial court acquitted him of uttering a false transfer form. The trial court's finding that the transfer was improper was contradictory. Consequently, the conviction was not supported by the evidence, and the appeal was allowed.

Court Disposition

appeal allowed; conviction quashed; sentences set aside; appellant to be set at liberty unless otherwise lawfully held.

Orders

  • The appeal is allowed.
