Criminal Appeal / Judgment

  1. 1 Whether the sentence imposed on the appellant was illegal, unlawful, harsh, or excessive.
  2. 2 Whether the sentences for the two counts should run concurrently or consecutively.
  3. 3 Whether the trial court exercised its discretion properly in sentencing.

Ratio Decidendi

The court found that although the trial magistrate was correct in ordering consecutive sentences since the offences were committed on different days and in separate transactions, the three-year sentences for each count were excessive in light of the value of the stolen items and the appellant's status as a first offender. The court exercised its appellate discretion to reduce the sentences to one year imprisonment for each count, to run consecutively, and ordered the appellant's immediate release as he had already served more than the substituted sentence.

Court Disposition

appeal allowed in part

Orders

  • The conviction on both counts is upheld.
  • The sentences of three years imprisonment for each count are set aside and substituted with one year imprisonment for each count, to run consecutively from the date of conviction.
