Ratio Decidendi

Given the existence of two competing certificates of title over the same parcel of land and allegations of fraud and irregularity, the court finds that the appropriate course at the interlocutory stage is to preserve the subject matter. Since the evidence is limited to affidavits and has not been tested in cross-examination, the court cannot conclusively determine ownership or the validity of either title at this stage. Therefore, an order is made that both the plaintiff and the defendants shall preserve the suit property and not deal with it to the detriment of the other party, with the order to be registered against the title until the final determination of the suit.
