The Court of Appeal found that the appellant failed to follow the mandatory procedural requirements under the Employment Act and its own Human Resource Manual when summarily dismissing the respondents. The respondents were not given an opportunity to be heard, nor were the reasons for termination explained to them as required by section 41 of the Employment Act. The appellant's selective reinstatement of other employees who participated in the same events, without clear criteria, amounted to discriminatory and inequitable treatment. The purported appeal process was found to be a sham, as it was conducted by the same officer responsible for the dismissals, violating the rule against bias....
