Ratio Decidendi

The court found that the claim was filed on 9th August 2018, more than three years after the cause of action arose on 10th January 2014, thus rendering the suit time barred under Section 90 of the Employment Act. Additionally, the court determined that neither the claimant union nor the deceased's son had locus standi to file the suit on behalf of the deceased employee, as there were no letters of administration presented. The absence of locus standi and the expiry of the statutory limitation period were both fatal to the claim. Consequently, the court struck out the entire suit as bad in law.
