The Court of Appeal held that although the respondent's summary dismissal was unlawful, the respondent was only entitled to damages strictly in accordance with the terms of the employment contract. Since the contract provided for a three-month notice period or payment in lieu thereof, and the respondent had already received payment for the notice period, leave allowance, gratuity, and salary for days worked, he was not entitled to any further payment.
