The trial magistrate erred by treating the Respondent's claim as one of unfair termination rather than constructive dismissal, despite the pleadings and submissions indicating the latter. The legal provisions applied by the magistrate pertain to employer-initiated termination, not to resignation or constructive dismissal. Since the Respondent did not cross-appeal, the appellate court was precluded from reviewing whether the facts supported constructive dismissal. The judgment of the lower court was therefore set aside, and a retrial was ordered before a different magistrate.
