Ratio Decidendi

The court found that the delay of about one month in filing the application for stay and extension of time was satisfactorily explained by the applicants as resulting from mis-diarization and late notification of the judgment date. The court noted that the appeal was only on quantum, as liability had been settled by consent, and thus there was no risk of the respondent losing the entire decretal sum. To balance the interests of both parties, the court ordered that 50% of the decretal sum be released to the respondent and the balance be deposited in a joint interest-earning account or in court as security. The intended appeal was to be filed within 14 days, and costs were to be in the cause.
