Ratio Decidendi

The court found that the freezing orders over the applicant's bank accounts, obtained by the police on the basis of alleged theft by servant, were not justified as no criminal charges had been brought against the applicant since the orders were issued. The court held that the orders were obtained without affording the applicant a hearing, contrary to Article 47 of the Constitution and Section 4 of the Fair Administrative Action Act. The continued freezing of the accounts, in the absence of any charges, amounted to an abuse of police powers and misfeasance of public office. The court concluded that the application for revision was merited and set aside the freezing orders.
