Procedural Posture

Employment Cause / Ruling on Interlocutory Application for Injunction and Reinstatement

  1. 1 Whether the applicant's summary dismissal was unlawful and in breach of due process.
  2. 2 Whether the applicant is entitled to interlocutory injunctive relief and reinstatement pending determination of the suit.
  3. 3 Whether damages are an adequate remedy in cases of unfair dismissal where due process is not followed.

Ratio Decidendi

The court found that the applicant was dismissed without being informed of the reasons or being given a hearing, in violation of her constitutional rights to fair labour practices and fair administrative action. The court held that the applicant had established a prima facie case for injunctive relief and that damages would not be an adequate remedy in the circumstances. The court further determined that since the applicant had not acknowledged receipt of the termination letter, the dismissal process was incomplete. Accordingly, the court ordered her reinstatement and payment of pending salaries, with the respondent at liberty to subject her to proper disciplinary procedures if desired....

Court Disposition

Application allowed. Applicant reinstated. Pending salaries to be paid. Respondent may initiate proper disciplinary process if desired.
