The High Court found that the Medical Practitioners and Dentist Council failed to accord the appellant a fair hearing in its disciplinary proceedings. The Council did not notify the appellant of the response filed by the 1st Respondent, nor did it invite him to comment on that response or any documentary evidence. This omission breached the rules of natural justice and the procedural requirements under the Medical Practitioners and Dentists (Disciplinary proceedings) (procedure) Rules, 1979. The court held that making inquiries without involving the complainant does not satisfy the requirement of a fair hearing.
