Ratio Decidendi

The court held that the Magistrate Court lacked jurisdiction to entertain the industrial dispute as exclusive jurisdiction is vested in the Industrial Court by Section 12 of the Labour Institutions Act. Any proceedings conducted by a court without jurisdiction are a nullity and cannot be cured by transfer to a court of competent jurisdiction. The suit before the Magistrate Court was therefore a nullity ab initio and must be dismissed. The appeal was allowed, the proceedings in CMCC No. 1868 of 2008 were declared a nullity, and the suit was dismissed with costs to the appellants.
