Ratio Decidendi

The Tribunal, bound by the Environment and Land Court's judgment, found it had jurisdiction to assess damages for loss of tenancy. The Applicant was evicted before the expiry of her lease term without proper notice as required under the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act. The Tribunal found that the Applicant was entitled to two months' rent in lieu of notice, as the Respondent failed to provide the statutory notice prior to termination. The Tribunal declined to award special damages due to lack of specific pleading and proof, but awarded general damages in the form of two months' rent, and ordered the Respondent to pay the costs of the application.
