Ratio Decidendi

The court found that the trial court erred in adopting a multiplicand of Kshs. 30,000 as the deceased's monthly income without any documentary evidence or reference to the applicable Regulation of Wages Order. In the absence of proof of actual earnings, the court should have reverted to the Regulation of Wages (General) (Amendment) Order, 2013, which provided for a monthly wage of Kshs. 23,972 for drivers of medium-sized vehicles. The dependency ratio of 2/3 was upheld as appropriate given the evidence that the deceased supported both his father and child. The appeal was allowed only to the extent of substituting the multiplicand, with all other awards remaining as made by the trial court.
