The plaintiffs failed to establish a prima facie case against the 2nd defendant as required for the grant of an interlocutory injunction. The 2nd defendant, having conducted a search and found the 1st defendant to be the absolute proprietor with no encumbrances, was entitled to accept the property as security for the loan. There was no evidence that the 2nd defendant was aware of any trust or family interest in the property, nor was there substantiated fraud. The statutory power of sale was properly exercised following default. The plaintiffs’ claim of irreparable harm was unpersuasive, as the property, once charged, became a commodity of sale and any loss could be compensated by damages....
