Procedural Posture

Originating Summons / Ruling on Application for Review of Orders

  1. 1 Whether the applicant has satisfied the grounds for review of the court's orders.
  2. 2 Whether failure to take directions in a matter commenced by way of Originating Summons renders the proceedings invalid and amenable to review.
  3. 3 Who should bear the costs of the application.

Ratio Decidendi

The court found that the omission to take directions in a matter commenced by Originating Summons constitutes an error apparent on the face of the record. Directions are a mandatory procedural step intended to clarify the issues and ensure proper presentation of evidence. Both parties, represented by counsel, failed to seek directions, and the applicant only raised the issue after an adverse judgment. Nevertheless, the court held that the absence of directions undermined the integrity of the proceedings, warranting review and setting aside of the previous orders. The matter is to commence afresh in compliance with the procedural requirements under Order 37 of the Civil Procedure Rules.
