The High Court found that although the offence of arson carries a maximum sentence of life imprisonment, the appellant was a first offender, had no previous records, and was also a victim of the fire as he lost his property. The trial magistrate considered these mitigating factors but the appellate court found the ten-year sentence to be excessive in the circumstances, particularly given the familial relationship between the appellant and the complainant, and the fact that the house was their shared home. The sentence was therefore reduced to five years' imprisonment, effective from the date of original conviction.
