Ratio Decidendi

The court found that the applicant had provided plausible reasons for the delay in filing the cross-appeal, including his transfer to Malindi and loss of contact with his advocate due to a lost cell phone. The delay of approximately two and a half months was not considered inordinate. The court also determined that the intended cross-appeal was arguable and not frivolous, and that no prejudice would be occasioned to the respondents, who had themselves filed an appeal against the same judgment. Applying the principles established in Leo Sila Mutiso v Rose Hellen Wangari Mwangi, the court exercised its discretion in favor of the applicant and granted leave to file the cross-appeal out of time.
