Procedural Posture

Civil Suit / Ruling on Objector's Application for Release of Attached Property

  1. 1 Whether the objector, as the wife of the judgment debtor, acquired good title to the attached vehicle after the issuance of the attachment warrant.
  2. 2 Whether the transfer of the vehicle to the objector was valid in light of ongoing execution proceedings.
  3. 3 Whether the objector was aware of the attachment and execution process at the time of the purported transfer.

Ratio Decidendi

The court found that the objector, being the wife of the judgment debtor and cohabiting with him at the time of attachment, was aware of the attachment and the application for stay of execution. The purported transfer of the vehicle occurred after the warrant had been served and before it was satisfied. In accordance with section 27 of the Sale of Goods Act, any alienation of property under attachment is invalid if the purchaser is aware of the unsatisfied warrant. The court concluded that the objector could not acquire good title to the vehicle while the attachment remained unsatisfied, and thus the vehicle remained the property of the judgment debtor and was properly subject to execution.
