Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the termination of the Claimant’s employment was lawful and fair.
  2. 2 Whether the Claimant is entitled to the remedies sought.

Ratio Decidendi

The court found that the Respondent failed to establish any identifiable performance benchmarks or appraisal reports to substantiate the claim of poor performance. There was no evidence that the Claimant was served with warning letters or given an opportunity to improve. The Respondent also failed to prove that the payment made was in lieu of notice rather than salary for December 2014. The court held that the termination was without justifiable cause and in violation of due procedure, entitling the Claimant to compensation for unfair termination and notice pay, but not to leave pay or further orders regarding the certificate of service.

Court Disposition

judgment for the claimant in part

Orders

  • The Respondent shall pay the Claimant six months’ salary in compensation for unlawful and unfair termination.
  • The Respondent shall pay the Claimant one month’s salary in lieu of notice.
