The Court of Appeal found that the trial court erred in awarding mesne profits for the period 1990 to 2004, as the respondent admitted that the appellant occupied the suit property with his consent during that time. Mesne profits are only payable for the period of trespass, which was from 2004 to 2008, after the respondent withdrew his consent. The court also found that the annual rate of Kshs. 10,000 for mesne profits was reasonable, given the agricultural use of the land and the evidence on record.
