Procedural Posture

Criminal Appeal / Ruling on Bail Pending Appeal

  1. 1 Whether the applicant is entitled to bail pending appeal.
  2. 2 Whether the appeal has overwhelming chances of success or raises a substantial point of law.

Ratio Decidendi

The court found that, upon review of the evidence adduced at trial, there was no apparent overwhelming chance of success in the applicant's appeal nor was there a substantial point of law likely to be determined in his favour. The evidence against the applicant, including the recovery of the stolen goat's meat from his family house and the testimony of a co-accused implicating him, was sufficient to support the conviction. The applicant's claims of a grudge by the assistant chief and challenges to the identification of the meat were not persuasive. Consequently, the court held that the application for bail pending appeal was not merited and dismissed it.
