Ratio Decidendi

The court found that the respondent had unequivocally offered to pay the claimant his terminal dues as detailed in the letter dated 30th January, 2015, subject only to the claimant surrendering all company property. The respondent is obliged to make the payment as represented. However, the court recognized the respondent's right to deduct the Kshs 100,000 advanced as cash bail from the terminal dues if the claimant had claimed the cash bail for his own benefit after acquittal. The application was therefore allowed to the extent that the respondent must pay the terminal dues as per the letter, less any amount properly deductible for the cash bail, and upon surrender of company property.
