The court found that the Plaintiff's occupation of the suit land from 1970 to 1975 was with the 1st Defendant's permission and thus not adverse. However, after the 1st Defendant demanded vacant possession in 1975 and the Plaintiff refused to vacate, the Plaintiff's continued occupation became adverse. By 1987, the Plaintiff had been in adverse possession for over 12 years, thereby extinguishing the 1st Defendant's right to recover the land under section 7 of the Limitation of Actions Act. The subsequent transfer of the land to the 2nd Defendant in 2011 did not defeat the Plaintiff's accrued rights as an adverse possessor.
