The court found that, although the applicants had pleaded guilty and the sentence imposed was lawful, the likelihood of delay in hearing the appeal due to court backlogs meant the applicants could serve a substantial part or all of their sentence before the appeal is determined. The applicants were first offenders, and while no exceptional circumstances such as ill health were proven, the risk of the appeals being rendered nugatory justified the exercise of discretion in their favour. The court held that these factors, taken together, constituted good cause for granting bail pending appeal, subject to appropriate bond terms and conditions.
