Ratio Decidendi

The court found that under Rule 11(3) of the Advocates (Remuneration) Order, leave is required before appealing a High Court decision in a taxation matter. The decision to grant leave is discretionary and should be exercised judicially. Although the applicant did not adduce detailed grounds for the intended appeal, the court was not satisfied that the intended appeal was fictitious or had no realistic prospects of success. The court also found that no prejudice would be suffered by the respondent other than the inconvenience of defending the appeal, which could be compensated by costs. Therefore, the applicant was granted leave to appeal to the Court of Appeal.
