Ratio Decidendi

The court found that the respondent's application for dismissal or striking out of the appeal was served on the wrong firm of advocates, namely Cherono & Company Advocates, instead of the advocates on record for the appellant, O.P. Ngoge & Associates. As a result, the appellant was not properly notified of the application and was deprived of the opportunity to respond. The court held that proper service is fundamental to the administration of justice and that proceeding in the absence of such service would be irregular and prejudicial. Consequently, the court stood over the application generally and directed that it be properly served and a hearing date fixed in the registry.
