Ratio Decidendi

The court found that the trial court erred in adopting a dependency ratio of 1/2 without providing reasons or considering the lack of evidence on the extent of dependency by the deceased's parents. The deceased was unmarried, aged 19, and there was no proof that he would have spent half his income on his parents. The court held that dependency is a question of fact and, in the absence of evidence, a ratio of 1/3 is more reasonable and consistent with appellate authority. The dependency ratio of 1/2 was therefore substituted with 1/3.
