Ratio Decidendi

The judge found that the fees allowed by the taxing officer for instruction and brief fees were almost double those allowed in recent comparable cases, even after accounting for inflation. The taxing officer's awards were therefore manifestly excessive. The judge held that, in accordance with rule 109(2) and established principles, he was justified in interfering with the taxing officer's discretion and reducing the fees to amounts that were reasonable and consistent with precedent. The instruction fee was reduced from Shs 12,000 to Shs 8,000, and the brief fee for senior counsel from Shs 14,000 to Shs 10,000. The applicant was also awarded costs of the reference.
