Procedural Posture

Civil Appeal / Ruling on Post Judgment Motion for Correction and Extension of Time

  1. 1 Whether the High Court has jurisdiction to correct an alleged clerical or mathematical error in the trial court's judgment after affirming the decree on appeal.
  2. 2 Whether the court is functus officio in relation to the correction sought by the appellants.
  3. 3 Whether the appellants are entitled to an extension of time to deposit the decretal sum pending clarification of the correct amount.

Ratio Decidendi

The High Court held that it lacked jurisdiction to correct the alleged error in the trial court's computation of punitive damages because it had already affirmed the decree on appeal and was therefore functus officio. The court found that any correction of clerical or mathematical errors must be sought from the court that issued the original decree, not from the appellate court after the appeal has been determined. The court also noted that the appellants did not raise the specific issue of an erroneous award on appeal, but only challenged the quantum as excessive. As such, the application for correction and extension of time was dismissed for lack of merit and jurisdiction.
