The court found that the respondent had a valid reason for declaring redundancy due to the completion of the road construction project and had substantially complied with the procedural requirements under Section 40 of the Employment Act, 2007, including notification and payment of certain terminal dues. However, the respondent erred in failing to compute terminal benefits based on the salary increment provided in the CBA effective from 1st July 2015, which applied to all claimants whose employment ended after that date.
