The court found that the Plaintiff had demonstrated, on a prima facie basis, the existence of a right that may have been infringed by the Defendant insurer, and that unless stay of execution was granted, the Plaintiff risked suffering irreparable harm through the sale of her property in execution of a decree arising from a judgment for which she claims indemnity under an insurance policy. The court held that justice required a balance between the interests of the Plaintiff and the Interested Party, who holds a lawful judgment. Accordingly, the court granted a conditional stay of execution, requiring the Plaintiff to deposit Kshs 100,000 as security and to settle the Auctioneer’s fees,...
