The trial court erred by failing to offer the applicant, a first offender who pleaded guilty, the statutory option of a fine as required under Section 62 of the Alcoholic Drinks Control Act. The court also failed to provide reasons for imposing a custodial sentence. The sentence of six months' imprisonment was excessive in the circumstances, particularly for a first offender. Exercising its revisionary jurisdiction, the High Court found that the appropriate sentence should have been three months' imprisonment, and since the applicant had already served this period, he was entitled to immediate release.
