Ratio Decidendi

The court found that while personal service of the order was effected on the 1st respondent, the order served was not endorsed with a penal notice warning of the consequences of disobedience. The Court of Appeal has established that such endorsement is a mandatory requirement for contempt proceedings. In the absence of a penal notice, the application for contempt is incompetent and must be dismissed. The court therefore dismissed the applicant's motion for contempt on the basis of non-compliance with this procedural requirement, regardless of the respondents' failure to appear or respond.
