Legal Issues
- 1 Whether the High Court has jurisdiction to review or resentence where a court of concurrent jurisdiction has already pronounced final orders.
- 2 Whether the doctrine of functus officio applies to the present application.
Ratio Decidendi
The High Court found that it was functus officio, having no jurisdiction to review or resentence the applicant because the final orders had already been made by a judge of concurrent jurisdiction. The doctrine of functus officio precludes a court from revisiting its own final decisions or those of another court of the same level, except as expressly permitted by statute or rules. Since the applicant's sentence had been conclusively determined and no statutory basis for review was established, the application for review or resentencing was dismissed for want of jurisdiction.

Ruling
1. I have considered the application and gone through the record in this matter.
2. It is clear that this matter was handled by Lady Justice H. Ongundi on 2nd January, 2021. The final orders are that the accused serves 30 years effective from 25th May, 2011.
3. This court is therefore functus officio and has no jurisdiction to review orders of a court with same jurisdiction.
3. Accordingly, the application for review/resentence is dismissed.
4. This file is marked as closed.Orders accordingly
