Ratio Decidendi

The Tribunal found that the landlord had issued a valid Notice to Terminate tenancy dated March 28, 2022, which was to take effect on June 1, 2022, and had provided sufficient evidence of service to the tenant's last known address. The Tribunal held that the notice met the statutory requirements under section 4 of cap 301, granting the tenant two months to vacate. As the tenant filed the reference after the notice period had lapsed, the tenancy relationship had already been legally terminated. The Tribunal was not persuaded by the tenant's claim of non-service and upheld the validity of the notice, granting the landlord leave to proceed to distress for arrears owed.
