Procedural Posture

Originating Summons / Ruling on Preliminary Objection

  1. 1 Whether the defendant has locus standi to be sued on behalf of the deceased registered proprietor of the suit property.
  2. 2 Whether the plaintiff's originating summons is incurably defective for failure to annex a certified extract of title as required by law.

Ratio Decidendi

The court found that neither the plaintiff nor the defendant had locus standi to sue or be sued in respect of the estate of the deceased registered proprietor, as neither had demonstrated appointment as legal representative. Furthermore, the plaintiff failed to comply with the mandatory requirement under Order 37 Rule 7(2) of the Civil Procedure Rules, 2010, by not annexing a certified extract of the title to the originating summons. The certificate of official search provided did not meet the statutory definition of a certificate of title, nor was it certified. These defects rendered the originating summons incompetent, warranting its striking out with costs to the defendant.

Court Disposition

originating summons struck out with costs to the defendant

Orders

  • The plaintiff's originating summons dated 29th November 2017 is struck out.
  • Costs awarded to the defendant.
