Since the Claimant was acquitted and not included in the 2006 redundancy process, she remained an employee until formally declared redundant in October 2013. The Respondent's attempt to backdate her retrenchment was in bad faith and unlawful. The Claimant is entitled to all withheld salaries from the date of suspension to the date of redundancy notification, and thereafter to redundancy benefits as per the 2006 terms.
