Ratio Decidendi

The court determined that it lacked jurisdiction to entertain the application because, following the enactment of the Environment and Land Court Act, 2012, disputes relating to ownership and title to land fall within the exclusive jurisdiction of the Environment and Land Court. The court further held that, upon dismissal of the original suit for want of prosecution, any interlocutory or eviction orders previously issued were extinguished and could not be enforced. As jurisdiction is a threshold issue that can be raised by the court on its own motion, the High Court was compelled to strike out the application for want of jurisdiction, rendering all other prayers and arguments moot.
