The High Court lacks jurisdiction to entertain the petitioners' applications seeking enforcement of the Court of Appeal's judgment regarding the constitution of the TNA party list for Nyeri County. The Court of Appeal's decision resulted in the gazettement of new County Assembly members, and under Article 105 of the Constitution and Part VII of the Elections Act, any challenge to the membership of the County Assembly after gazettement must be by way of an election petition. The present applications, which seek to question the membership of the County Assembly, are therefore incompetent and must be struck out as the High Court is functus officio in this matter.
