Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the trial magistrate erred in holding the appellants 100% liable in negligence for the accident.
  2. 2 Whether the award of general damages was inordinately high and unsupported by evidence.
  3. 3 Whether the trial court failed to consider all relevant evidence and legal principles in its judgment.

Ratio Decidendi

The appellate court found that the appellants' pleadings and their driver's testimony confirmed the occurrence of the accident and contradicted their denial of involvement. The trial magistrate was justified in holding the appellants 100% liable, as the evidence did not support shifting blame to the unidentified motorcyclist. The appellate court also held that the award of Kshs. 600,000 in general damages was not inordinately high given the respondent's injuries, and there was no basis to interfere with the trial court's assessment. The appeal was therefore dismissed for lack of merit.
