Procedural Posture

Preliminary Objection / Ruling on Preliminary Objection Prior to Hearing Substantive Application

  1. 1 Whether the preliminary objection raised by the 1st Defendant discloses pure points of law capable of disposing of the suit at a preliminary stage.
  2. 2 Whether the Plaintiff has locus standi to institute the suit as administrator ad litem of the estate of the deceased.
  3. 3 Whether the suit is fatally defective for non-compliance with Civil Procedure Rules regarding pleadings and witness statements.

Ratio Decidendi

The court found that the preliminary objection raised by the 1st Defendant did not disclose any pure points of law, as the issues of locus standi and the Plaintiff's relationship to the deceased were disputed facts requiring evidence. The alleged procedural defects regarding witness statements and documents were unfounded, as the original plaint had complied with the relevant Civil Procedure Rules. The challenge to the authenticity of annexures could not be resolved at the preliminary stage without calling evidence. Therefore, the preliminary objection was not capable of disposing of the suit at this stage and was dismissed in its entirety with costs to the Plaintiff.
