The High Court held that it has jurisdiction to entertain a fresh application for stay of execution under Order 42 Rule 6(1) of the Civil Procedure Rules, even where a similar application was refused in the lower court, provided an appeal from the substantive decision has been lodged. The court found that the lower court's judgment had been partially executed (the burial had occurred), but execution for costs and potential exclusion from succession proceedings remained live issues.
