Ratio Decidendi

The court found that the applicant purchased the motor vehicle during the pendency of objection proceedings and after a stay of sale order had been issued. The sale and subsequent transfer of the vehicle to the applicant were therefore in direct contravention of the court's stay order. As a result, the sale was illegal and could not confer lawful title to the applicant. The court held that the applicant's remedy, if any, lay against the plaintiff and the auctioneer for a refund through a separate action, not through the current suit. Consequently, the applicant's motion to be enjoined as an interested party and to set aside the consent orders was dismissed.
