The court found that Getrude Chao Waita was the registered owner of the suit property and held an indefeasible title, as the property was not listed as part of the deceased's estate in the relevant succession proceedings. There was no evidence that Getrude held the property as trustee for the estate. The purported sale to Mary Waruguru Waita was invalid for lack of a written contract as required by Section 3(3) of the Law of Contract Act, and would also have been void under the Law of Succession Act if the property was part of the estate, as the sale predated confirmation of grant.
