The court held that the applicant, having pleaded guilty and been sentenced, had a right of appeal as to the extent or legality of the sentence under section 348 of the Criminal Procedure Code. However, instead of appealing, the applicant sought revision. Section 364(5) of the Criminal Procedure Code expressly bars revision proceedings at the instance of a party who could have appealed but did not.
