The court held that while the reasons advanced by the applicants for the delay in filing the notice of appeal were not entirely plausible, in the interests of justice and given the nature of the matter, it was appropriate to grant an extension of time to file the appeal. The court found that it retained discretion under Section 95 of the Civil Procedure Act to enlarge time for acts prescribed by the Act, including the filing of a notice of appeal. However, the court determined that it was functus officio with respect to granting injunctive relief after delivery of its final judgment, as such jurisdiction lies with the Court of Appeal.
